Leave Out All The Rest is the fifth episode in Season Nine of CSI: Crime Scene Investigation.

Synopsis[]

When the team investigates a case involving the world of domination, Grissom pays a visit to Lady Heather to help find some answers.

Plot[]

The episode opens as Grissom, who has just watched a video message from Sara, heads out to a crime scene in the rain. When he arrives, he finds the victim covered in a tarp, which has contaminated the evidence. Catherine, who is in the process of trying to preserve a tire tread, tells him that first responder is responsible for doing so. The victim is a male with no forms of identification on him, and David Phillips puts his time of death at two to four hours ago. His face has been reduced to a pulp and is full of asphalt; the fingers and toes are also gone. Ligature marks on the wrists and burnt motor oil on the shirt suggests that he was tied to the undercarriage of a vehicle with a high ground clearance, such as a truck or SUV.

In autopsy, Nick examines the victim's shirt and finds that it contains nine stab wounds. Doc Robbins points out that there was no blood flow in the facial scrapes, meaning that the injuries happened postmortem. Furthermore, there's no bruising from the rope burns and no clotted blood in the stab wounds, meaning that those injuries happened postmortem, as well. The victim has strange puncture wounds around his nipples that are inconsistent with tattoos or piercings; however, there's no presence of ink or metal.

Come daylight, Catherine returns to the scene where the body was found along with an unwilling Hodges. She casts the tire track she saved in the mud earlier and finds a length of bloody rope with burnt ends. The working theory is that the victim was tied to the undercarriage of a truck, but when the rope melted, the body dropped onto the road. This led the driver to drag the body into the middle of the desert as an accidental body dump. Catherine tells an inquisitive Hodges that the killer likely tied the body under the truck just in case they were stopped by the police.

The softball shirt helps identify the victim as Ian Wallace. Nick, Riley and Brass go to the Ian's address and find no signs of forced entry; Ian's identification is on a table. Riley notes the smell of citrus and finds evidence of blood on the living room sofa, while Nick finds evidence of a bloody fistfight in the hallway, as there's a blood drop with an air bubble in it down by the baseboard of the wall.

Henry informs Catherine that Ian had low levels of THC and alcohol in his system. Meanwhile, Grissom watches a video from Sara; she's on a research boat south of the Equator and is happy for the first time in a long time.

Back in Ian's house, Nick notices that Ian's car is in the garage, but the other spot is empty. He also found some fresh oil stains and rope burns, indicating that Ian was tied up in his own garage. The back door to the house is also unlocked. As suggested by parts of the furniture and the women's magazines in the house, Riley realizes that Ian was living with a woman; the magazines identify her as Justine Stefani.

In the lab, Doc Robbins presents more strange findings from the autopsy. The symmetrical puncture marks around the nipples were made with 18-guage needles. Furthermore, Ian also had electrical burns on his tongue; however, there were no other burn marks in the oral cavity. The doc labels the cause of death as manual strangulation and believes that the killer used their bare hands. Based on the restraints, the nipple stimulation, and the burns, Grissom questions whether Ian took part in S&M. The stab wounds, however, were random and postmortem, which doesn't quite fit the theory.

As a result of the findings, Grissom consults an expert on the subject: Lady Heather, who since their last meeting has become a sexual therapist, dealing in "patients," not "clients". She informs him that the puncture marks come from a practice called "stacking," in which the nipples are raised and made more sensitive using needles. The burn marks on the tongue, meanwhile, came from electrical torture done with a pair of metal chopsticks. All of this suggests that Ian was a submissive, meaning he was probably in a sexual relationship with a dominant.

At Ian's house, Greg, Nick and Riley are notified to look for any S&M paraphernalia in the bedroom. Greg finds a butt smudge on the television and semen stains on the stand. Riley comes across a picture of Justine with breast implants, but hits the mother lode with a chest under the bed that's filled with S&M gear. In the closet, Nick finds a bloody shirt in the laundry basket; its bloodstains match the puncture marks on Ian's nipples. Riley theorizes that Justine killed Ian, redressed him, and tied him under the car, but the guys don't think she could do that on her own.

Grissom shows Lady Heather the photos from the bedroom and she believes that since there's no dedicated sex room in the house, Ian didn't "play" at home. This is confirmed when she sees a picture of a card for the Lower Linx club, which she says has a well-equipped back room.

Brass and Nick visit the club, but find the owner, Michelle Tournay, uncooperative. She claims not to recognize Ian or Justine and refuses to let them in until Nick decides to stick around in the reception area and scare off customers. At that point, she lets them into the back room, where they find gear that might've caused the S&M injuries on Ian. Michelle claims that she has the only key to the room.

In the lab, Wendy's tests of a patch of seminal and vaginal fluid found on the television stand reveal that Ian was having sex with another woman, which might be a motive for murder. Wendy also finds high-velocity blood spatter on the back of Ian's shirt and notes that expiratory blood can mimic high-velocity gun spatter; someone (possibly the killer) spit blood onto Ian's back. Meanwhile, having seen photos of their house, Lady Heather figures that Justine isn't a dominant and wouldn't have killed Ian even if she caught him cheating on her. The next morning, Catherine and Brass process a burnt-out car with a charred corpse and partially melted breast implants inside. License plates indicate that the owner of the car is Justine Stefani.

Using the serial numbers on her breast implants, Doc Robbins identifies the body as Justine. Seventy-five percent of her body is covered in third degree burns and her hands are tied behind her back; the doc concludes that she was bound ante-mortem. The other injuries on the body and evidence found near the car indicate that she was killed by being run over with her own SUV by two people, one of whom has size nine shoes and one of whom drives a car with two different brands of tires. Due to a crack in the axle of the SUV, the vehicle became undrivable, which is why the killer torched it. The CSIs figure that Justine was kidnapped from when she walked in on the two attackers at home. Nick's testing of the metal chopsticks from the Lower Linx club show that the center saliva DNA is a match to Ian, but unknown female DNA is on the ends. The unknown DNA isn't a match to Justine, but it did match the vaginal secretions found in the house. They suspect that the assertive Michelle Tournay might've been Ian's dominant and may have been sleeping with him, as well.

Justine's phone records show that the last call she received was from a Martin Devlin, an insurance salesman. He tells Brass that he had called Justine not long before she was killed and says that he had never been to her house. Meanwhile, Grissom discusses the case further with Lady Heather. She tells him that Ian's dominant is a female who likely had an male accomplice, or "slave."

Nick interrogates Michelle and collects her DNA. During the questioning, she admits to having had sex with him, but not in either one of their houses. Wendy informs Riley that the blood spatter on Ian's shirt has seven alleles in common with a convicted felon with the last name of Devlin. Martin is brought back in for questioning, where Riley and Brass find out that he has the same S&M injuries as Ian. They theorize that Martin helped Michelle kill Ian and tried to frame Justine, adding that Martin tied Ian's body under the car and followed Michelle out into the desert. Things went awry, which led to Martin killing Justine and setting her car on fire. Martin's lawyer cuts the conversation short before he can answer.

At Lady Heather's home, she suggests to Grissom that the postmortem stab wounds would imply that the killer is a sexual sadist who probably wouldn't seek out the S&M world; therefore, the killings aren't S&M related. Lady Heather also notes that Grissom could've gathered this information from a textbook; he's been visiting her for a more personal reason. It's soon revealed to the viewers that the video message Grissom got from Sara was a goodbye message in which she breaks up with him. In the video, she tells him that his not making a decision to pursue her was the decision. Lady Heather guesses that Grissom paid her a visit because her house was the only thing that didn't remind him of Sara. She extends an offer to Grissom for him to stay as long as he would like in the guest bedroom.

Archie and Riley search Martin Devlin's phone and find that he sent Justine an image after calling her: a photo of his own lawyer having sex with Ian. However, the text was sent to a stranger whose number was one digit off from Justine's. During questioning, the lawyer admits to having been with Ian on the night of his murder, but left before it happened. She explains that things got really intimate between her and Ian while they and Martin were engaged in S&M to the point that Martin broke character. Later at his house, she told Ian she wanted to have a full relationship with him, but he turned her down. Martin walked in on them and attacked Ian, after which he and she left. She claims that she watched Martin drive away; sometime after that, Ian was killed. While it's possible Martin came back later and killed Ian, she believes there's no way he would've killed Justine, especially so brutally.

In the lab, the CSIs summarize the case and conclude that they can't link any of their suspects to any of the crime scenes; shoe sizes and tire impressions don't match either Martin or his lawyer. They conclude that the S&M angle was probably incidental, but Nick disagrees, saying that they followed the evidence. Since the back door to Ian's house was unlocked, the murders may have just been a random attack carried out by two people unrelated to the investigation who broke into the house, killed Ian, and kidnapped Justine. Catherine believes that there's still evidence out there that they haven't come across yet.

Meanwhile, Grissom spends the night at Lady Heather's and asks her to stay with him in the guest bedroom.
